Request for assistance

We were hoping we could manage without getting to the point of needing to look at extra funds, as things were going along very nicely, and though putting in enormous hours, we were doing things that didn’t cost a significant amount of 'real money'. Many have already offered funds, and we've so far declined help.
However, things have changed somewhat recently, one being that Smyth continues to 'issue more paper' like the US treasury department!!
We need to react strongly and urgently to this recent issue of 45 million shares. It is imperative that we  do a very quick mail out to the top 1020 holders on the register (people with 100,000 shares or more) that are NOT known to us, detailing a mailing address and name for proxies, and pointing out all the facts that are available to you all on the website.
There are also documents we would like to purchase from entities holding the required data, more complex and more expensive than simply purchasing copies of the share register.
So we do need your help to make contact with these people who could very well help the cause.

Information is being brought to light which makes it even more important that at some time in the not too distant future, we seek to engage a Corporate Lawyer. More on the specifics of that as and when we are able to. We realise this seems an insufficient statement, but until the EGM is finalised, it's impossible to go into more details, but this is obviously for all shareholders' benefit. Of course we expect some detractors regardless of how justifiable the request is, but know the majority of holders will understand the sensitive nature of what we are dealing with.

Due to the disturbing fact that Computershare are not being used as the neutral body collecting and counting votes, and that it is being completed 'in house' by CVI makes us even more determined to set up a method to ensure that all your votes are counted properly and completely. We hope to be able to engage scrutineers on a vountary basis. We are seeking shareholders assistance who are going to the EGM.

Steve and I will attend the meeting at the end of January, and all the things on the list to be completed are not only taking our time,(roughly 60 hours a week currently on CVI)  but of course they are preventing us from concentrating on our own incomes fully, and of course we have put in a considerable amount of our own funds to date.
So – in brief, we’d like to be able to fund a mail out ($1000 including printing, envelopes and postage) and then start to get a REAL fighting fund together for future legal costs with a decent deposit for that action.
We propose to do it on a basis where funds NOT used (if legal costs do NOT go ahead) are refunded to the donors pro rata. We are very aware that we have nearly all been financially burned (badly) by CVI in the last year, and that excess funds are not something that many have.

People who DO feel able to make a donation to the fund, please email us at This e-mail address is being protected from spambots. You need JavaScript enabled to view it and we will send banking details of your choice. We will issue receipts, audit and book keep properly.  This auditing information will be available to ALL donors so you can be sure you funds are fully accounted for.

We appreciate any help given, and we were reluctant to ask, but in light of the proxy situation and the legal future, it seems more necessary. Even a deposit for ‘legals’ would be a good start if the other things can be covered by a small amount from many.

Can give options of a BPay, electronic transfer or bank deposit, PayPal or post a cheque. As the Shareholders group isn't a registered business, so cheques / gifts will need to be made out to S Turner or S Coughlan as we have accounts with no fees to maximise the benefit of each dollar. (If posting with proxy vote)
We will keep full records of these transactions, and they will be available to all who donate.
Please tell us if you want an official receipt for your records - though they will not be tax deductible I'm afraid.

Thanks all.......look forward to explaining in more detail as soon as we are able.

Voting Results - Under the Surface

The 116 signatories to the original EGM request will no doubt recall the very first resolution that was put to the Board at that time:

That the non-renounceable pro rata entitlements issue announced by the company to the ASX on 7th November 2008 be withdrawn and, if deemed necessary by the board, the offer is to be reissued on terms that permit the issue of no more than 20% of currently issued capital."

Who is Malcolm Keith Johnson?
News letter to CVI Shareholders  Mark Smyth issued a copy of an Angolan document (Diario de Republica, issue 62 April 2008) to show that Nhefo has been gazetted and Canzar has exploratory rights to the concession"    It in fact showed that mining rights had not been granted but were still subject to meeting of certain conditions. Only exploration was allowed. That is not all it showed. There was something else there, something lurking in the background. There was a very interesting name. MALCOLM KEITH JOHNSON. The name rang a bell.
